Court of Appeal, on appeal from the High Court concerning an application by a father for the return of a child to Moldova, orders an adjournment of the appeal pending the final determination of a Moldovan court as to whether the removal of the child had been wrongful, in circumstances where there had been consent to the child moving from Moldova to Canada but the mother had remained in Ireland.
Child abduction – Part III of the Convention on the Civil Aspects of International Child Abduction – the Hague Convention – application for the return of baby A to Moldova – Article 12 of the Hague Convention – appeal of High Court order refusing to direct return of baby A – whether the mother intended to leave Moldova for a temporary period where no consent was required or whether her actions are more consistent with an intention to leave permanently where consent would be required – fathers custody rights – it is not appropriate for the court here to rely upon an interpretation of decisions by a court in Moldova which not only postdate the date of removal, but which were also are made in a context other than in respect of issues strictly arising on an application under the Hague Convention – appeal adjourned
