The High Court, in a solicitor's appeal against findings of professional misconduct, has refused an application for a trial of a preliminary issue concerning the procedures of the Solicitor Disciplinary Tribunal. The Tribunal had found the solicitor guilty of misconduct in a property transaction, and while the solicitor sought to challenge the Tribunal's procedures, the High Court determined that a complete rehearing of evidence was mandated unless all parties agree otherwise, which was not the case here.
Solicitor's appeal - Professional misconduct - Full rehearing - Tribunal procedures - Solicitors (Amendment) Act 1960 - Rules of the Superior Courts (RSC) - Judicial review - Bias and fair procedures - Property transaction - Conflict of interest
