Court of Appeal defers a final decision on an appeal concerning the interpretation of regulatory powers under EU law, pending a reference to the Court of Justice of the European Union (CJEU), in circumstances where the appellants challenged the Sea Fisheries Protection Authority's insistence on quayside weighing of their fish catch, arguing that the existence of a derogation under a control plan approved by the Commission should preclude such a requirement; and the court refers the matter to the CJEU for a definitive interpretation of the relevant EU Regulation, particularly whether the Authority may require quayside weighing despite the derogation.
