High Court makes an order granting liberty to the applicant to disclose certain documentation from the couple’s family law proceedings in support of a complaint to the Legal Services Regulatory Authority, finding that the relevant statutory provision no longer requires that leave of the court be sought before disclosure is made.
High Court - Family Law (Divorce) Act, 1996 - Civil Liability and Courts Act, 2004 - section 40 - 7th July, 2023 - notice of motion - law changed slightly by Courts and Civil Law (Miscellaneous Provisions) Act, 2023 - new section 7A - not a "two-step" process - allows applicant to produce a document or give information in limited circumstances - previous orders varied - order granted allowing disclosure of documentation to An Garda Síochána to support criminal complaint - order granted allowing An Garda Síochána to disclose to DPP - no order regarding discovery necessary.
