High Court, in European Arrest Warrant proceedings, adjourns the proceedings to allow the Minister for Justice to liaise with Lithuanian authorities so that the Court’s concerns about prison conditions and the management of prisons in Lithuania can be addressed.
European arrest warrant – Lithuanian authorities seeking respondent’s surrender – custodial warrant - failed to comply with the requirements as to the suspension of his sentence -sentence reactivated - substantive error in the EAW – wrong provision stated – points of objection – no correspondence - disproportionate interference with his right to respect for his private and family life - EAW is ambiguous and unclear - would be exposed to prison conditions and/or the risk of violence from other prisoners such as would breach his right to freedom from inhumane or degrading treatment - very real risk that a person incarcerated in Lithuanian prisons will be subjected to inhuman or degrading treatment – Court would not surrender the respondent unless the Lithuanian authorities can address to the Court’s satisfaction the concerns raised about the conditions in and management of prisons – Court adjourns case to allow the Minister for Justice to liaise with Lithuanian authorities.
