High Court grants damages of €97,000 against restaurateur and restaurant architect for broken ankle caused by trip and fall down steps in restaurant, because no handrail was provided on dark coloured stairs with low lighting.
Personal injuries – negligence – trip and fall in restaurant – patron suing occupiers and architects – broken ankle – whether failure to provide handrail on steps – whether failure to illuminate steps adequately – whether failure to mark nosings of steps – all 3 defendants negligent in failing to provide a handrail on steps: liability apportioned 50% on 1st and 2nd defendant occupiers, 50% on 3rd defendant architects – no contributory negligence – €45,000 general damages to date; €55,000 future general damages – overall award €97,000.
