Court of Appeal substitutes more lenient sentence for assault causing harm and suspends the balance that had not been served yet by the appellant, on the grounds that: (a) the headline sentence was unduly severe given the circumstances of the case; (b) there were significant mitigating factors; and (c) the new material now before the court justified suspending the balance of the sentence.
Offence: assault contrary to s. 3 of the Non-Fatal Offences Against the Person Act 1997
Original sentence: three years, with final year suspended on conditions
Appeal by: defence
Outcome: new sentence substituted of two years, with the entire balance of the sentence suspended
