Court of appeal, in a supplemental judgment to a previous judgment of the court in which judgment was granted in favour of a bank against the appellant in the sum of €7,683,999.96, dismisses motion in relation to the locus standi of the bank to continue as respondent and defend the appeal against the judgment, on the grounds that what is sought to be upheld is an order for judgment of 6th March 2015, and the bank did not agree to sell on the loans to another finance company until after that date.
Banking law – motion in relation to the locus standi of Bank of Scotland p.l.c – question not expressly dealt with in the judgment – whether BOS is entitled to remain as a respondent – BOS did continue to have locus standi to continue as the respondent in the appeal in the judgment proceedings – what is sought to be upheld is an order for judgment of 6th March 2015, and the bank did not agree to sell on the loans to another finance company until after that date - motion dismissed.
