High Court refuses an application by plaintiffs, in a claim against the organisers of a property investment consortium, to be released from their undertaking in other proceedings not to use documents received in discovery, on the grounds that the plaintiffs had failed to establish the existence of special circumstances to satisfy the court that the documents in question were: (a) of obvious relevance in the proceedings; and (b) necessary in the interests of justice.
Application to use discovery in separate proceedings - release from undertaking - claim against organiser of investment consortium - purchase of UK shopping centre - losses sustained by investors - discovery received from defendants in other proceedings - settlement of proceedings - some plaintiffs in both sets of proceedings - special circumstances - whether injustice would result - circumstances of original disclosure.
