Court of Appeal dismisses appeal against conviction for membership of an unlawful organisation, on the grounds that: (a) the admission of belief evidence was not unfair, nor did the terms on which privilege was claimed and upheld undermine the belief evidence such that no reliance could be placed on it; and (b) the ruling of the Special Criminal Court on the belief evidence did not undermine the fundamental fairness of the trial or render the trial unsatisfactory.
Appeal against conviction for membership of an unlawful organisation - appellant stopped with co-accused and both searched pursuant to Misuse of Drugs Act - vehicle they were travelling in then searched - discovery of replica of an explosive device believed to be for training purposes - car owned and driven by co-accused and not appellant - whether insufficient evidence to ground the belief evidence of chief superintendent admitted at trial - whether belief evidence based merely on appellant's presence in the car - whether privilege could be asserted in respect of the belief evidence.
