Breach of interpretation regulations does not invalidate detention or breath sample evidence

Court of Appeal determines that, despite breaches of regulations on interpretation and translation for persons in custody in Garda Síochána stations, the defendant's detention remained lawful and the breath sample evidence admissible. The breaches, related to the failure to inform the defendant that an interpreter was deemed unnecessary and to record this decision, were deemed administrative and not a violation of constitutional rights. The court emphasised that there was no causal link between the breaches and the obtaining of the breath specimen, and the trial judge retains discretion to admit the evidence, considering all relevant factors.
