High Court, on appeal from the Master's Court, in proceedings concerning allegations of abuse by foster parents, orders discovery of confidential documents, but permits the documents to be redacted to exclude any extraneous reference to third parties, the court noting that, where an application for an order for discovery is made in respect of confidential documentation, the court should only order discovery in circumstances where it becomes clear that the interests of justice in bringing about a fair result of the proceedings require such an order to be made.
Discovery - practice and procedure - civil procedure - discovery of documents -appeal from Master's Court - should the HSE and the CFA be compelled to make specific categories of discovery in a case involving allegations of abuse against individuals under their care - child in foster care - need to balance the plaintiff's need for evidence against the privacy rights of non-parties - discovery order but permitted to be redacted.
