The Court of Appeal dismissed an appeal from the High Court, and affirmed the refusal to quash a conviction in the Circuit Court (on appeal from the District Court) of assault of the accused's brother, on the grounds that the Circuit Court judge had not applied the wrong test, and there was no evidence of that the accused had been subjected to a 'reverse onus' of proof.
