Court of Appeal allows appeal of severity of sentences imposed for a number of burglaries, and in respect of all appellants reduces the appropriate sentence to four years with varying levels of suspension, on the grounds that the Circuit Court judge erred in taking as a starting point a sentence of seven years’ imprisonment.
Criminal law – sentencing – appeal against severity of sentences imposed for a number of burglaries – Circuit Court judge erred in taking its starting point a sentence of seven years imprisonment – appropriate starting point would have been one of four years imprisonment – sentence imposed on Mr. James Cash will be set aside and there will be substituted a sentence of four years imprisonment with 20 months suspended – sentences in respect of Messrs. Wall will be set aside and there will be substituted sentences of four years with two years suspended in each case – appeal allowed.
