Northern Irish High Court sets aside public contract for training and apprenticeship programs, on grounds that tendering process did not clearly set out information required from tenderers.
Public procurement - contracts for training and apprenticeship programmes - challenge by unsuccessful applicant - Regulation 47G(1) of the Public Contracts Regulations 2006 - contracts of "part b" variety - failure of applicant to meet certain criteria - failure to provide "data in respect of achievements, success rates or destinations into positive outcomes" - whether relevant information had been requested in tendering process - requirement that tenderers demonstrate successful track record - invitation to other tenderers, but not plaintiff, to provide further information or clarification of bids - whether criterion so formulated as to permit all reasonably well informed and normally diligent tenderers to interpret it uniformly - whether decision vitiated by manifest error - whether selection panel was in error concerning the relevant competition rule - proportionality.
