The High Court has refused judicial review of a decision of the Financial Services and Pensions Ombudsman (FSPO) to refuse to entertain a complaint by a non-proving executor concerning the banking records of a deceased person, on the grounds that the application was outside the statutory time limit. The applicant had reserved his rights and not extracted a grant of probate, so did not have standing to make the complaint. The court also proposed that each party should bear its own legal costs, recognising the public interest in clarifying the law on the matter.
