High Court refuses to grant mandatory injunction requiring a solicitor to transfer files to a former client, where his properties had been taken into receivership and other litigation was pending, on the grounds that: (a) insufficient evidence had been provided to show that the files in question would be of assistance in the other litigation; and (b) the solicitor in question had sworn that the files were no longer in his possession, such that any order against him would be unjust.
Application for injunctions - transfer of files by solicitor - purchase and mortgage of lands and house - receivers appointed over properties - action by receivers against borrower - borrower unable to obtain files from solicitor - destruction of files - failure to exhibit pleadings in other proceedings.
