Court of Appeal dismisses appeal of convictions imposed for attempted rape, sexual assault and the restriction of the personal liberty of a child for the purposes of sexual exploitation committed by a step father, on the grounds that the decision whether to give a corroboration warning (where there was evidence from a sleepover of witness who did not remember anything happening) was, by statute, a matter for the trial judge’s discretion.
Criminal law – conviction appeal – attempted rape, sexual assault and the restriction of the personal liberty of a child for the purposes of sexual exploitation – 3(2) of the Child Trafficking and Pornography Act 1998 – whether the trial judge ought to have given a corroboration warning – evidence from a sleepover witness who did not remember anything happening – warning was by statute a matter for the trial judge’s discretion – appeal dismissed.
