Court of Appeal dismisses appeal against a costs order in favour of the second named defendant in relation to a Norwich Pharmacal application, arising out of defamation proceedings in which the plaintiffs sought information relating to a number of twitter accounts, on the grounds that: the plaintiffs had undertaken to discharge the second defendant's costs of the motion and the costs of complying with the order; and the fact that the second defendant contested the terms of the order, and not the making of the order itself, had not relieved the plaintiffs of their undertaking to pay the second defendant's costs.
Costs of legal proceedings - Norwich Pharmacal - defamation - costs of motion - costs of complying with order - posts on Twitter - in Plaintiffs' affidavits it was averred that the Plaintiffs would undertake to pay the Second Defendant's costs of the motion and the costs of complying with the order.
