Court of Appeal quashes sentence for assault causing harm on the grounds of undue leniency and substitutes less lenient sentence, finding that: (a) this was a case where the custody threshold was crossed for reasons including, inter alia, that there were significant physical injuries for the injured party; and (b) while the court had sympathy for the respondent's mother, the sentencing judge erred in not sending the respondent to prison simply because his mother depended on him.
Offence: assault causing harm
Original sentence: three and a half years imprisonment, suspended for four years
Appeal by: prosecution (statutory application)
Outcome: sentence quashed and new sentence imposed of two years simpliciter
