High Court awards damages in the sum of €160,968 for personal injuries suffered by the plaintiff in a road traffic accident, finding that: (a) the plaintiff was not travelling at excessive speed; and (b) the plaintiff lost control of his vehicle as a result of being blinded by the full lights of the defendant's truck.
Road traffic accident – Plaintiff claims he was driving within the speed limit, was blinded by the full lights of the Defendant’s truck as he rounded a corner and collided with the Defendant – Defendant claims the Plaintiff was driving at great speed and was not in control of his vehicle – Court satisfied that the evidence demonstrates the Plaintiff was driving at the speed he stated – Court accepts explanation that the accident occurred because the Plaintiff was blinded by lights – supported by evidence – Plaintiff suffered significant pain and disablement – unable to pursue his career as an electrician or continue to play Gaelic football – total damages awarded to Plaintiff of €160,968.
