High Court, in an assessment of damages only in respect of a road traffic accident, finds that the accident aggravated a pre-existing degenerative condition of the plaintiff's, and grants an award of damages in the sum of €60,000 in general damages and €20,000 in special damages.
Court has already dealt with the liability issue between the parties at the request of the parties - before the court for the purposes of assessment of damages - road traffic accident which gave rise to these proceedings occurred on the 21st day of March, 2008 - total items of special damage sought are €29,037.38 - evidence of plaintiff and plaintiff's general practitioner - evidence of consultant in neurophysiology - evidence of specialist in anaesthesia and pain medicine - evidence of consultant radiologist - evidence of wife of the plaintiff - evidence of consultant orthopaedic surgeon - evidence of defendants doctor - Court finds that accident did aggravate a pre-existing degenerative condition, as a matter of probability - award of €80,000 given.
