High Court grants judicial review of the decision of the Minister for Justice to order the deportation of Pakistani mother and her daughter, on the grounds that: the Minister erred in law and in fact in making the decision to deport; the Minister's deliberations in the deportation matter are inchoate; the decision to deport was unreasonable; and the Minister erred in law in failing to have adequate regard to the factors set out in legislation to be considered when determining whether or not to make a deportation order.
Asylum and immigration – judicial review – Pakistani national and her daughter challenging the deportation orders– brother became a UK national – DNA - DNA evidence shows that the applicants have been telling the truth all along as to their being blood relatives – claims of dependency become credible – mother’s story – onerous level of documentation had to be provided – refused application for EU treaty rights – review refused – deportation process ensued – submissions – deportation order made - interests of public policy and the common good in maintaining the integrity of the asylum and immigration system – examination of their file – family rights – Minister erred in law and perhaps also fact in making the decision to deport – Minister’s deliberations in the deportation matter are inchoate - the decision to deport was unreasonable Minister erred in law and perhaps also fact in failing to have proper regard to their personal circumstances – time for challenging EU rights decision expired – judicial review of deportation orders granted.
