High Court awards the defendant the costs of their successful application to have proceedings remitted to the Circuit Court, with a stay on execution pending the resolution of the proceedings, on the grounds that, having succeeded in his application, the defendant was, prima facie, entitled to recover the reasonable costs he has incurred in this regard.
Costs of legal proceedings - application by the defendant following a successful application to have the matter remitted to the Circuit Court - whether the costs should be reserved - Section 169 of the Legal Services Regulation Act 2015 - Order 99, r. 2 of the Rules of the Superior Courts - costs follow the event - costs awarded to the defendant with a stay on execution pending the determination of the proceedings.
