High Court grants a supermarket employee an award of damages in the sum of €50,000 for a knee injury, on the grounds that the injury was caused by the plaintiff tripping over loose cables situated by the chair of the check-out where she worked, and her employer should have taken more care as regards her surroundings.
Personal injuries - proceedings arise as a result of an accident which occurred on the 16th of May 2012, in the course of the Plaintiff’s employment by the Defendant at its supermarket premises - plaintiff is a long term employee of the Defendant having been employed as a sales assistant for approximately 17 years and following a period of recuperation she returned to work in May, 2015 - apparent contradiction in how plaintiff fell and injured her right knee - CCTV footage was mislaid - plaintiff gave evidence that prior to the date of the accident there had been safety at work meetings at which the problem of loose cabling under checkouts in general had been raised as an issue though she herself had not attended any of those meetings - Court is satisfied that the accident occurred in the way, manner and circumstances as described by the Plaintiff in her evidence and that as a result she sustained an injury to her right knee - Plaintiff should have been aware of the loose cabling - plaintiff awarded €50,000.
