Court of Appeal overturns the High Court's decision to strike out a case for inordinate and inexcusable delay, spanning from 2007 to 2023. The plaintiffs, referred to as "the Campion interests," had appealed the High Court's dismissal of their multi-faceted claim against "the County Council," which included allegations of misfeasance in public office and breach of legitimate expectation, among others. The Court of Appeal found that the County Council had not sufficiently demonstrated that the delay had caused a level of general prejudice that would justify dismissing the proceedings. The case has been remanded to the Non-Jury List for case management and is expected to go to trial within the next calendar year.
