High Court upholds the detention of a South African national, rejecting the contention that the individual's detention was unlawful due to an alleged arbitrary curtailment of their statutory right to challenge a deportation order within 28 days, on the grounds that the seven-day requirement to leave the State, as stipulated in the deportation notice, did not infringe upon the individual's right to seek a legal challenge, and that the individual had been properly served with the deportation documentation, deeming the detention lawful.
Article 40.4.2 of the Constitution - deportation order - unlawful detention - South African national - Cloverhill Prison - Illegal Immigrants (Trafficking) Act 2000 - section 5(oj) - International Protection Act 2015 - prohibition of refoulement - judicial review - habeas corpus - statutory right to challenge - notice of deportation - Immigration Act 1999 - service of documentation - right to legal challenge - High Court.
