Court of Appeal dismisses application by the Director of Public Prosecutions (DPP) for a review of sentences imposed for being unduly lenient for a variety of charges, including assault of an elderly man causing harm including a broken shoulder, on the basis that the sentencing judge took a range of factors into consideration, including the mental health of the offender and was therefore best placed to assess sentencing and held that the sentence imposed by the Circuit Court judge was not unduly lenient.
Appeal against sentencing – sentencing – DPP seeking review of sentences imposed – undue leniency – respondent pleaded guilty to all offences – Non-Fatal Offences Against the Person Act 1997 – application refused - victim being an elderly man - broker shoulder - mental history of offender.
