Discovery ordered of documents that could establish intention of parties as to scope of restrictive covenant

High Court - discovery - second and third defendants seek discovery of documents from the Plaintiff - interpretation of a negative covenant in a lease - if there was a document which showed what the parties agreed was meant by a particular term in a contract, that document would be admissible as evidence of the true interpretation of the term in the contract - Court orders discovery be made of all documents that would establish what was the agreement or understanding reached between the parties as to the scope of the restrictive covenant in relation to the selling of food products at the store in question - one category agreed - Court refuses to make an order for discovery of various documents relating to the purchase price of the property and negotiations relating to the negative covenant as they are not relevant, particularly in light of the plaintiff abandoning their claim for damages if a permanent injunction is granted - Court refuses to grant discovery of various categories of documents relating to a counter claim by the second and third defendants that the covenant was void as having regard to s. 4 of the Competition Act 2004 as they were not relevant.
