High Court, in an action concerning the grant of a mobile phone licence tender in 1996, directs one of the defendants, a businessman, to make discovery of documents provided to him by a tribunal of inquiry, and to make them available for inspection, on the grounds that the public interest in the administration of justice outweighs any alleged confidentiality attached to the documents, which were widely circulated during the Tribunal's public hearings. The original decision to withhold the documents has been set aside, as the court determined that the interests of justice in ensuring a fair trial are paramount.
