Court of Appeal dismisses appeal of eight-year sentence (with final two suspended) imposed in Cork Circuit Court for drug possession offences, on the basis that there was no error in principle in the disparity between the appellant’s sentence and that of the co-accused where the circumstances of the offence and the part played by the appellant were taken into account.
Criminal law – sentencing – appeal against severity of sentence of five years imprisonment in respect of the first offence and a concurrent sentence of eight years imprisonment on the second offences, with final two suspended – s. 15 & s.15A of the Misuse of Drugs Act 1977 – disparity between the sentence imposed on the appellant and that imposed on her co-accused – appellant was the main instigator of the s. 15A offence and organised the whole affair – appeal dismissed.
