High Court refuses to quash District Court decision not to grant separate Legal Aid (District Court) Certificates (where one already existed) in a case where there were two separate and unrelated prosecutions, arising out of different incidents, on different dates and prosecuted by separate gardaí, on the grounds that to "split" the legal aid certificate into two would not be in accordance to law.
Criminal law – legal aid – application to quash refusal of District Judge to grant separate Legal Aid (District Court) Certificates – whether separate legal aid certificates ought to be assigned on the basis that there were two separate and unrelated prosecutions, arising out of different incidents, on different dates and prosecuted by separate gardaí – s. 2 of the Criminal Justice (Legal Aid) Act 1962 – s.6 of the Criminal Justice (Miscellaneous Provisions) Act 1997 – Regulation 7(4) of the Criminal Justice (Legal Aid) Regulations 1965 – decision of District Judge was in accordance with law and he did not have legal authority to act otherwise – applicant is not entitled to an order of certiorari quashing the refusal of the first named respondent to grant a separate Legal Aid (District Court) Certificate.
