High Court, in an assessment of damages, grants an award in the sum of €91,881 to a man who, while stationary in a vehicle as a front seat passenger, was collided into by the defendants.
Personal injuries - action arises out of an accident which occurred in May 2013 - plaintiff was a front seat passenger in a stationary vehicle when the defendants vehicle collided with the back of it - plaintiff alleged that he suffered injuries to his neck, back and an injury to his right middle finger - liability has been conceded, so the action came before the court as one for an assessment of damages - special damages were agreed in the sum of €6881 - plaintiff had been involved in a road traffic accident seven years before this incident, suffered a whiplash injury to his neck and received €15,000 as compensation - plaintiff also fell down a flight of stairs and fractured his right middle finger - plaintiff underwent microdiscecetomy surgery in January 2016 - plaintiff claims to experience pain every day in his neck and back - consultant neurosurgeon accepted that the plaintiff had some pre-existing degenerative changes in his back, however did not suffer from back pain before the accident - court also accepts the plaintiff suffered minor injury to his right middle finger - overall award of €91,881 given.
