High Court grants an order of certiorari in respect of a decision of the Minister for Justice that the applicant did not come within the principles set down by the Court of Justice of the European Union, which would have meant that he was entitled to be removed from the State pursuant to an EU Directive rather than be deported pursuant to domestic legislation, having acquired EU Treaty rights as a qualifying family member, on the grounds that the reasoning in the impugned decision was not sufficient, and that on that basis the decision must be set aside and that the matter will have to be considered afresh by the Minister.
