High Court upholds the decision to terminate the employment of the plaintiff, rejecting the plaintiff's claim that he was dismissed for alleged misconduct without fair procedures, the court finding that the plaintiff was not dismissed for misconduct, but rather due to a "dire" situation and "dysfunction" within the organisation; that the respondent had the contractual right to terminate the plaintiff's employment without fault; and the plaintiff had not established a strong case likely to succeed at trial.
