High Court rules that there was nothing in European Union law or human rights law to permit a litigant to be represented in court by anyone other than a duly qualified lawyer.
Plaintiff not represented by a solicitor or counsel but was accompanied by a McKenzie friend - the McKenzie friend has no right to address the court unless invited to do so by the presiding judge and at this time the presiding judge is not inviting the McKenzie friend to address the court - the right of audience is regulated by law - Article 19 of the Statute of the Court of Justice regulates the representation of parties in proceedings before the Court of Justice of the European Union - Only a lawyer authorised to practise before a court of a Member State or of another State which is a party to the Agreement on the European Economic Area may represent or assist a party before the court.
