High Court, in European Arrest Warrant proceedings, orders the surrender of the respondent to Poland, on the grounds that the evidence provided in relation to his mental health condition and the disruption to his private and family life fell short of justifying an order refusing his surrender.
European arrest warrant – custodial warrant - Polish authorities seeking the respondent’s surrender – respondent previously surrendered to Poland in connection with the same offence – surrender was for the purpose of prosecution – understood his sentence to be suspended – came to Ireland – points of objection – delay – family life within the State – argued that his surrender would be a disproportionate interference with his family rights - real risk of a flagrant denial of justice – medical evidence - unexplained period of delay - delay does not of itself constitute a ground for refusal of an application for surrender – surrender would not cause exceptional disruption - evidence falls considerably short of establishing that his condition is such as would justify an order refusing his surrender- surrender ordered.
