High Court grants the plaintiff leave for an extension of time to issue execution in respect of an order for possession, on the grounds that: (1) the plaintiff had met the threshold of establishing a good reason, such as engaging with the defendants to alternatively address the debt, for the failure to execute the order for possession; (2) this meets the threshold for a reasonable explanation; and (3) no prejudice will be suffered by the defendants in extending time to issue execution of the order.
Practice and Procedure – application for an extension of time to issue execution of an order for possession – Order 42, rule 24 of the Rules of the Superior Courts – good reason – order of possession – leave granted.
