High Court grants judicial review of a decision refusing an Albanian national international protection, on the grounds that the Tribunal’s failure to give the applicant an opportunity to make submissions as to the veracity of certain documents and the Tribunal’s failure to translate certain documents were a breach of fair procedures.
Asylum and immigration – judicial review – Albanian national challenging decision refusing him international protection - sought international protection on the basis that he is the subject of a “blood feud” in his country and that his life would be in danger if he returned there – argued that the tribunal erred in the manner in which it dealt with certain documents – not given an opportunity to make submissions as to the veracity of the documents - denied fair procedures in the sense that he was never afforded an opportunity to address any issue perceived by the IPAT to present as regards the authenticity of the documents - erred in failing to assess certain Albanian-language documents provided and failing to have the documents translated – failure to give reasons for not having the documents translated – failure to have the documents translated was a breach of fair procedures – judicial review granted –
