High Court, in giving effect to a previous judgment, grants an order joining a finance company as an additional plaintiff to summary judgment proceedings, and orders that the company is entitled to some of its costs but not all of its costs, in circumstances where it obtained the joinder order but did not pursue its application for a substitution order.
Previous judgement handed down on 1 April 2020 – corrected due to errors in numbering of paragraphs – parties unable to come to terms on costs and exchanged concise written submissions – defendants claim no order would be appropriate and argue plaintiff has no right to seek its costs – plaintiff claims costs should follow the event – plaintiff entitled to some of its costs as it obtained a joinder order but withdrew application for a substitution order – defendants opposed the application for a substitution order in full and it was not a procedural application – errors in judgement were clerical and not fatal – just order is for defendants to bear half of plaintiff’s costs – directions given regarding the balance of the case.
