High Court refuses judicial review of an alleged refusal by a government department to provide environmental information, on the grounds that: (a) there had been no refusal, in circumstances where the department simply wrote back to enquire whether the information was sought under 'freedom of information' (FOI) or 'access to information on the environment' (AIE) legislation; and (b) it was a reasonable requirement in the implementing directive that the applicant state the legislative procedure being invoked, so that the application could be dealt with by the appropriate officer.
