High Court refuses all applications brought by first defendant, seeking relief in respect of settlement agreement entered into by the parties to the proceedings.
Application for declaration that first defendant, a company, was not bound by terms of the settlement - various other/ancillary applications also made in respect of settlement agreement - application brought by notice of motion despite proceedings being initiated by special summons - decision of court to hear applications regardless - witnesses tendered for cross-examination - differing evidence given on factual events leading to the settlement and whether first defendant was bound - whether settlement was in first defendant's interests - costs orders made.
