Supreme Court, on appeal from the High Court: (a) suggests a number of questions that the High Court should raise with the Polish authorities concerning a European arrest warrant (EAW) for an offence committed in 1999, where a subsequent offence of 2003 had given rise to an earlier, 2012, EAW which had failed due to a legal challenge; but (b) retains the appeal pending the answers to the suggested questions.
Charleton J (nem diss): European arrest warrant - issued by Poland - refusal to execute earlier warrant - whether issue of second EAW was abuse of process - in absentia activation of suspended sentence - request for further information - need for clarity - offence of possession of drugs - offence in 1999 - suspended sentence - further offence in 2003 - EAW in 2012 - lapse in time - delay of 20 years between offence and EAW - dependent son - questions to be asked by High Court - appeal retained by Supreme Court.
