The Court of Appeal upheld the High Court's decision to award costs to a couple in a property dispute involving their garage, which was mistakenly not conveyed to them despite payment. The High Court found that the couple's rights were violated when individuals associated with the construction company, which was erroneously registered as the owner, damaged the garage and disregarded the safety of the couple's animals housed there. The Court of Appeal affirmed the finding of contempt against one individual who breached court orders and undertakings by continuing aggressive communication with the plaintiffs. The original decision to award costs against the individual and the construction company on a joint and several basis for the contempt motion, as well as against all defendants for the interlocutory motion, was upheld.
