The High Court has referred key questions to the Court of Justice of the European Union (CJEU) concerning whether national guidelines imposing binding apartment design standards require a strategic environmental assessment before adoption. The applicants challenged the validity of these guidelines, arguing that they should have been subject to public participation and assessment under EU environmental law. The referring court found that these binding requirements could alter the framework for future development consent and may effectively override or amend development plans previously subject to environmental assessment, raising fundamental issues under EU and international conventions. The judgment is adjourned pending the CJEU’s preliminary ruling, with priority requested for the referral due to the significance and urgency of the issues for national housing policy.
