Court of Appeal, in an ex tempore judgment, dismisses appeal and upholds decision of the High Court refusing the appellant leave to seek judicial review of an order for possession made by the Circuit Court, on the grounds that: (a) the appellant had raised no arguable ground upon which leave could be granted; (b) all the grounds were entirely misconceived and amounted to no more than an attempt to an appeal on the merits; and (c) the allegation of objective bias against the Circuit Court and High Court judges was completely without basis.
Noonan J (nem diss): Ex tempore judgment - Judicial review - appeal of a decision of the High Court refusing the appellant leave to judicially review an order for possession made by the Circuit Court -the appellant sought to judicially review a decision of the Circuit Court making an order for possession of the appellant's house in favour of the Bank - the appellant had not appealed the decision to make an order for possession - the appellant argued that the Circuit Court did not have jurisdiction to make the order in question - whether the Circuit Court and High Court were biased - whether the Circuit Court had jurisdiction to make the order - appellant should have sought to appeal original decision rather than proceed by way of judicial review - appeal dismissed.
