The Court of Appeal dismissed an appeal from the High Court, and affirmed a decision to dismiss a defamation and malicious falsehood action against the Legal Aid Board refusing legal aid to a litigant in respect of professional negligence proceedings where he had failed to establish reasonable grounds. The appellant had claimed that the letter contained defamatory statements and malicious falsehoods by implying he had engaged in an abuse of process in his professional negligence actions. The Court of Appeal agreed with the High Court's assessment that the letter was not capable of bearing a defamatory meaning and that there was no evidence of malice, thus affirming the original decision to dismiss the claims.
