Court of Appeal refuses a habeas corpus application to release prisoner who is jailed on foot of breaching High Court orders, finding that his detention is lawful from the material available to the court and that he may appeal the underlying reasoning behind the civil contempt proceedings.
Criminal law – application pursuant to Article 40.4.2 – habeas corpus –civil contempt – applicant was and continues to be in breach of orders made by the High Court – attachment and committal – appeal more appropriate remedy than Article 40 application – application refused.
