High Court: (a) determines that a plaintiff tripped and fell at a specific location and suffered an injury to his wrist, despite a number of inconsistencies in his evidence; (b) assesses damages at €35,000, in light of the damages already recovered and the fact that the injury did not imprint significantly on the plaintiff; and (c) in light of a subsequent agreement between the parties, orders that the defendant pay €30,000 together with costs at the Circuit Court scale (including reserved and discovery costs).
Personal injuries - alleged trip and fall - location of fall - whether alleged fall caused injuries - injury to left wrist - no mention of such injury in records of emergency department - damages - whether wrist fracture was 'minimally displaced' or 'moderately severe'.
