High Court awards damages of €50,000 for pain and suffering to date, €15,000 for pain and suffering into the future and special damages of €4,193.82 in personal injuries proceedings arising from rear-ending of plaintiff's taxi, on the grounds that: (a) the accident occurred as a result of the unsafe driving of the defendant and was therefore caused by the defendant’s negligence; (b) an impact that causes only minor damage to vehicles can cause injury to an occupant of a vehicle; and (c) on the balance of probabilities, the plaintiff suffered the injuries that he described as a result of the road accident.
Personal injuries claim - rear ending of plaintiff’s taxi by defendant - following accident plaintiff suffered back pain - MRI disclosed significant stenosis - physiotherapy required - medical evidence - expert engineering evidence - whether incident was minimal impact collision such that there could not be the degree of injury described by the plaintiff - whether plaintiff's injuries caused by the collision.
